Terms and Conditions – MCP Cloud Platform

Welcome to MCP Cloud ("the Platform"). MCP Cloud is an online platform that enables registered users to:
- Launch and use open-source MCP servers provided by the MCP community.
- Add and manage their own MCP servers and make them available to other users under a chosen license.
- Deploy MCP servers as a service that can be used by other users on a pay-per-call basis.
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with these Terms, you must discontinue use of the Platform immediately.
2. Definitions
- "Platform" – The MCP Cloud system, website, APIs, and related services.
- "User" / "You" – Any person or entity using MCP Cloud.
- "MCP Server" – A Model Context Protocol server, whether open-source, user-developed, or otherwise available on the Platform.
- "Open-source MCP Server" – An MCP server licensed under an open-source license and made available for use via the Platform.
- "User-developed MCP Server" – An MCP server created or uploaded by another MCP Cloud user.
- "Deploy" / "Deployment" – The action of launching an MCP server instance within the Platform environment.
- "Pay-per-call Service" – A server usage model in which the deploying user charges other users for server calls, where one functional use case may require multiple calls.
3. Scope of Service
MCP Cloud provides the infrastructure for launching, running, and interacting with MCP servers.
MCP Cloud does not own, operate, audit, or control the MCP servers made available on the Platform.
MCP Cloud does not warrant that any MCP server will be free of defects, errors, malicious code, security vulnerabilities, or that it will function as intended.
The Platform may display MCP servers created by:
- The open-source community
- Individual or organizational MCP Cloud users
4. Disclaimer of Responsibility
4.1 General Disclaimer
MCP Cloud shall not be liable for any kind of damage, loss, or expense (including, without limitation, loss of data, profits, revenue, goodwill, or business opportunities) arising from:
- Use of any MCP server on the Platform
- Failure, malfunction, downtime, or inaccuracy of any MCP server
- Security vulnerabilities, exploits, or breaches related to MCP server use
- Incompatibility of MCP servers with your systems or environment
4.2 Open-source MCP Servers
- All open-source MCP servers on the Platform are provided “AS IS”.
- Users must review the source code and documentation of any MCP server before deployment or use.
- Users assume all risks associated with using open-source MCP servers.
- MCP Cloud does not guarantee that the server is safe, secure, compliant, or appropriate for any specific use case.
4.3 User-developed MCP Servers
- MCP Cloud provides a marketplace-like environment for users to upload and share MCP servers.
- MCP Cloud does not verify, review, audit, or endorse these user-developed servers.
- The responsibility for performing due diligence before use lies entirely with the user intending to deploy or consume such a server.
- Any licensing terms for these servers are between the server creator and the end user; MCP Cloud is not a party to such agreements.
5. User Responsibilities
By using MCP Cloud, you agree that:
- You are solely responsible for ensuring that the MCP servers you deploy or use are: Safe, Legal in your jurisdiction, and Appropriate for your intended purpose.
- You will perform your own testing and verification before using MCP servers in any critical or production environment.
- You will comply with all applicable laws, regulations, and licensing terms of MCP servers.
- You will not hold MCP Cloud responsible for: downtime, performance issues, security incidents, or any consequential losses.
6. Pay-per-call Services
MCP Cloud allows users to deploy MCP servers as paid services where other users are charged per server call.
Important: One functional usage session may involve multiple calls; it is the user's responsibility to understand the cost implications before using such a service.
MCP Cloud is not responsible for:
- The cost incurred by users
- The correctness of the output
- The frequency of calls made by the server
The payment arrangements and server behavior are between the deploying user and the consuming user.
7. Limitation of Liability
To the maximum extent permitted by law:
- MCP Cloud and its owners, affiliates, employees, and contractors shall not be liable for any damages, whether direct, indirect, incidental, special, punitive, or consequential, including but not limited to financial loss, business interruption, loss of information or data, legal claims from third parties, or security breaches.
- This limitation applies regardless of whether the damages arise from use or inability to use the Platform, any MCP server behavior, performance, or malfunction, or any negligence, omission, or fault of MCP Cloud.
8. Indemnification
You agree to indemnify and hold harmless MCP Cloud, its operators, and affiliates from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from:
- Your use of any MCP server
- Your development or deployment of MCP servers
- Your violation of these Terms
- Any infringement of intellectual property rights by your use or deployment of MCP servers
9. Modifications to the Terms
MCP Cloud reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform. Continued use of the Platform after the effective date of the changes constitutes your acceptance of the modified Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where MCP Cloud is operated, without regard to its conflict of laws principles.
